This has never been out of the box and the seals are intact,however,the glue on the front plastic has dried up and the plastic is partially loose,and thus pushed in,slightly. Dust may have accumulated inside because of this.
There is a sticker on the bottom indicating this was imported by Diamond Comic Distributors in the US.
This is the 1P Kaizoku version,released in 2007,and is 7.41 inches in height.
